Legal Advice

Personnel of the Macomb County Clerk's Office are not attorneys and thus are forbidden by law to give legal advice. Assistance with filling out forms in most instances constitutes legal advice.

Filling Out Forms Completely

Make sure all forms are filled out completely prior to filing. If you are filing in person and your paperwork is not complete, it will be necessary to step out of line to finish your paperwork so our deputy clerks can assist other customers.

Filing of Court Papers

Filing of court papers may be done in person, by mail, or by utilizing our fax filing service. Please make sure to include a self-addressed stamped envelope for return of any date stamped copies when filing by mail. Court Forms

The State Court Administrator's Office has most all approved court forms available via their website at: http://courts.michigan.gov.

Packets for filing domestic relations motions regarding support, custody and parenting time are available through the Clerk's Office Court Section and the Friend of the Court Office.  If you are filing one of these motions, be sure to read all instructions and fill out the necessary forms completely prior to filing.  You will want to check availability of the judge's motion dates by phone or by viewing the judge's motion calendar: CLICK HERE.  Please note that hearing dates can not be set by phone, however, you can obtain a date to file by mail if you choose. 

Divorce Cases

The forms necessary for filing divorce cases are not available through our office. Visit The State Court Administrative Office (SCAO) for SCAO-Approved Court Forms. Also, there is a book called "The Michigan Divorce Book" available at most major bookstores that includes some instructional guidance which can be helpful.

Friend of the Court

Office Hours

The Court Section of the Macomb County Clerk's Office is open Monday through Friday -- 8 a.m. to 4:30 p.m.  Our office is busiest on Mondays and Fridays and during all afternoon hours. The best time to visit our office is Tuesday, Wednesday, or Thursday mornings.
