Legal Advice

Personnel of the Macomb County Clerk's Office are not attorneys and thus are forbidden by law to give legal advice. Assistance with filling out forms in most instances constitutes legal advice.

Filling Out Forms Completely

Make sure all forms are filled out completely prior to filing. If you are filing in person and your paperwork is not complete, it will be necessary to step out of line to finish your paperwork so our deputy clerks can assist other customers.

Filing of Court Papers

Filing of court papers may be done in person, by mail, or by utilizing our fax filing service. Please make sure to include a self-addressed stamped envelope for return of any date stamped copies when filing by mail. The forms necessary for filing divorce cases are not available through our office. Friend of the Court

Packets for filing some motions regarding domestic relations matters involving minor children may be available through the Friend of the Court Office. If you are filing one of these motions, be sure to read all instructions carefully and fill out the necessary forms completely prior to filing. You may want to check availability of the judge's motion dates by phone. Though a date cannot be set by phone, this will enable you to file by mail if you so choose.
